Maximum possible sentence for misdemeanors changed to 364 days in California, effective Jan. 1, 2015

This bill will make the maximum possible sentence for a misdemeanor 364 days rather than one year. This is a great legislative win and thanks to everyone who worked on it! This will help recent LPRs who are convicted of misdemeanor crimes involving moral turpitude, for those applying for non-LPR cancellation of removal.


Anyone facing criminal charges, especially those with 5 years or less since admission as an LPR or who may need to apply for non-LPR cancellation should try to continue the case until next year and get re-charged under the new law. Please consult expert legal counsel.
